Terms of Service

1.Who we are
Trading as Quiet Review, a sole proprietor in South Africa.

“We”, “us” and “our” mean Quiet Review. “You” means the person or business using the Service.
2.Agreeing to these Terms
By creating an account or using Quiet Review (the “Service”), you agree to these Terms. If you are agreeing for a business, you confirm you may bind that business. If you do not agree, do not use the Service.
3.What the Service does
Quiet Review gives your business a review link. A customer opening it rates their experience from one to five stars.
- 4 or 5 stars — the customer is directed to your Google review page.
- 1 to 3 stars — the customer is offered a private feedback form. That feedback appears in your dashboard and is not sent to Google, unless you have chosen to also route lower ratings there.
You control this routing from your dashboard, including whether lower ratings are also offered a route to Google. Your dashboard shows review activity, analytics and private feedback.
4.Eligibility
You must be 18 or older and able to enter contracts. The Service is intended for business use.
5.Your account
You are responsible for keeping your login details secure and for activity under your account. Tell us at support@quietreview.com if you suspect unauthorised access.
One account covers one business. Multiple locations each need their own account and subscription.
6.Your responsibilities
6.1 Authority over the Google listing. You confirm you own or are authorised to represent the Google Business Profile you connect. Connecting a listing you do not control is a material breach and we may terminate your account immediately.
6.2 Google’s policies. Google sets its own rules on how businesses solicit and handle reviews, and changes them without notice to us. You are responsible for ensuring your use of the Service complies with those rules. We do not control Google, cannot guarantee your configuration complies, and are not responsible for any action Google takes against your listing, your reviews or your business.
6.3 The law where you operate. Rules on soliciting customer reviews differ by country, and some regulators treat selective handling of negative feedback as a deceptive or unfair practice. You are responsible for satisfying yourself that your use of the Service is lawful where you operate.
6.4 Honest use. You must not fabricate, incentivise or manipulate ratings so they misrepresent genuine customer sentiment; submit ratings for your own business or arrange for others to do so; or mislead customers about what happens to their feedback.
6.5 No legal advice. Nothing on our website, in our documentation, in our marketing or in our settings is legal advice.
7.Acceptable use
You must not:
- Interfere with the Service, probe its security or circumvent rate limits
- Attempt to access another account’s data
- Share, resell or sublicense your account
- Scrape or bulk-extract data
- Upload unlawful, infringing or malicious content
- Use contact details collected through the Service to send unsolicited marketing in breach of POPIA or other applicable law
We may suspend or terminate accounts that breach this clause.
8.Trial, subscription and payment
Trial. New accounts receive a 3-day free trial. No payment details are required and your review link works immediately.
Price. R450 per month per business, or R4,800 per year per business paid annually in advance. These are introductory rates. We may increase them, and will give you at least 30 days’ notice before an increase applies to you. You may cancel before it takes effect. An increase never applies part-way through a year you have already paid for.
Payment. Payments are processed by Paystack. Their terms govern the transaction. We do not store your card details.
No payment method at trial end. Your account enters a 5-day grace period during which your review link stays active. If no payment method is added by the end of it, your review link stops working until one is.
Failed payment. The same 5-day grace period applies. We email you immediately and show a notice in your dashboard. Your review link stays active throughout.
Renewal. The subscription renews at the end of each billing period — monthly or annually, according to the plan you chose — until cancelled. There is no minimum period beyond the period you have paid for. You can switch between monthly and annual from your dashboard; the change takes effect at the end of your current billing period, and nothing is charged until then.
9.Cancellation and refunds
Cancel any time from your dashboard. Cancellation takes effect at the end of your current billing period — your review link works until then and you are not charged again.
Your 5-day cooling-off right. You may cancel within 5 business days of first subscribing and receive a full refund, without giving a reason. This applies whether we approached you directly or you signed up yourself. Where we approached you directly, this right is also protected by section 16 of the Consumer Protection Act.
Email support@quietreview.com within 5 business days. Refunds are made to the original payment method within 15 business days.
Outside that window, payments already made are not refundable, except as our Refund Policy provides for the annual plan, but you may cancel at any time to stop future charges. The Refund Policy also sets out the limited circumstances in which we may refund at our discretion.
10.Your data and your customers' data
Your account data is processed to provide the Service — see our Privacy Policy.
Your customers’ feedback belongs to you. We store and process it so we can show it to you. We do not sell it and do not share it with Google or anyone else.
Deleting your account removes your account and all associated data — business details, ratings, private feedback, analytics and any uploaded image — within 30 days. This cannot be undone. Records we must keep by law for tax or accounting are retained for as long as the law requires.
11.Availability
We aim to keep the Service running continuously but do not guarantee uninterrupted availability. We may change or remove features and will give reasonable notice of significant changes where practicable.
The Service depends on third parties including Google, Paystack, and our hosting and email providers. We are not responsible for their outages.
12.Ending the agreement
You may delete your account at any time from your dashboard.
We may suspend or terminate your account if you breach these Terms, with notice where reasonably practicable, or immediately for serious breach — including connecting a Google listing you do not control.
13.Warranties and liability
We provide the Service with reasonable skill and care. Beyond that, and to the extent the law allows, the Service is provided as it is, and we do not warrant that it will be uninterrupted, error-free, or that it will produce any particular result for your business.
To the maximum extent permitted by law:
(a) We are not liable for indirect or consequential loss, including lost profits, lost business, lost goodwill, or loss of anticipated savings.
(b) We are not liable for any act or omission of a third-party platform, including any action Google takes in relation to your business, your listing or your reviews.
(c) Our total liability to you for all claims arising in any 12-month period is limited to the amount you paid us in that period.
Nothing in this clause excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act where it applies to you.
14.Indemnity
You indemnify us against claims, losses and reasonable legal costs arising from:
(a) your connection or use of a Google Business Profile you do not own or are not authorised to represent;
(b) your breach of clause 6 or clause 7; or
(c) content you or your customers submit through the Service that is unlawful or infringes someone else’s rights.
This indemnity does not apply to the extent a claim arises from our own breach of these Terms or our negligence.
15.Complaints and disputes
Email support@quietreview.com first — most issues are resolved quickly that way.
If we cannot resolve it, you may refer the matter to the National Consumer Commission or an accredited consumer ombud. Nothing in these Terms prevents you from approaching a court.
16.Governing law
These Terms are governed by South African law, and the South African courts have jurisdiction.
17.Changes to these Terms
We may update these Terms. For significant changes we will give reasonable notice by email or in the app. Continuing to use the Service after a change means you accept the updated Terms.
18.General
If any part of these Terms is unenforceable, the rest continues to apply. Not enforcing a right does not waive it. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between us.
